TERMS AND CONDITIONS OF USE

CollegeOne Suite and Mobile Applications (Android & iOS)

These Terms and Conditions of Use (“Terms”) govern the access, use, and responsibilities of all individuals using CollegeOne Suite and its mobile applications (“Platform”), including students, parents/guardians, and school staff (collectively, “Users”).

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Definitions

  • Platform: CollegeOne Suite and its mobile applications.
  • Institution: School or educational organization that administers the Platform and manages user accounts.
  • User: Any person accessing the Platform, including students, parents/guardians, and school staff.
  • User Content: Information, files, tasks, messages, media, activity responses, feedback, voice recordings, and any other content uploaded or generated within the Platform.
  • Activities: Educational content created by school staff for students.
  • Student Data: Personal information and academic records of students, including Education Records under FERPA.

2. Account Registration

  • All student and parent/guardian accounts are created, assigned, and managed exclusively by the Institution.
  • Users must access the Platform only with credentials provided by the Institution.
  • Users are responsible for maintaining the confidentiality of account credentials provided by the Institution.

3. Minor Users

  • Students under 18 years of age use accounts fully managed by the Institution.
  • COPPA does not directly apply since the Institution controls account registration and supervision; however, privacy standards equivalent to COPPA are maintained.
  • Parents/guardians supervise student use through institution-assigned accounts.

4. Acceptable Use Policy (AUP)

To protect the security, integrity, and proper functioning of CollegeOne Suite and its mobile applications, Users agree to strictly comply with the following AUP:

Users must not:

  1. Use the Platform in violation of applicable law, including export, privacy, and data protection laws.
  2. Post unauthorized commercial communications, including spam, promotional messages, or advertisements.
  3. Engage in illegal marketing schemes, including pyramid schemes.
  4. Upload, transmit, or introduce viruses, malware, malicious code, or programs intended to damage or disrupt the Platform.
  5. Access, collect, or attempt to obtain credentials from other users without authorization.
  6. Use the Platform to violate privacy rights, collect personal information without consent, or for unlawful purposes.
  7. Intimidate, harass, threaten, or use the Platform for abusive, violent, or discriminatory purposes.
  8. Post or approve content that infringes intellectual property, contractual, or privacy rights of third parties.
  9. Upload, transmit, or distribute content that:
    • Constitutes hate speech, harassment, or discrimination.
    • Is defamatory, pornographic, obscene, violent, terrorist, incites suicide or self-harm, or promotes dangerous behavior.
    • Includes explicit images of violence or abuse, including toward animals.
    • Promotes child sexual exploitation or violates child pornography laws. CollegeOne will report suspected cases to competent authorities.
  10. Use the Platform deceptively, fraudulently, illegally, or maliciously.
  11. Perform actions affecting availability, appearance, or functionality of the Platform, including denial-of-service attacks.
  12. Attempt unauthorized access to computer systems or databases.
  13. Use automated tools (bots, scrapers, crawlers, data mining) without authorization.
  14. Use falsified headers, manipulated IP addresses, or false identities.
  15. Use the Platform in ways that disparage or negatively affect CollegeOne or participating institutions.
  16. Impersonate CollegeOne employees, school authorities, or others.
  17. Post, transmit, or distribute content harmful to minors.
  18. Copy, modify, or redistribute materials without written authorization.
  19. Facilitate or encourage violations of these Terms or related policies.

Non-compliance may result in immediate suspension or termination of access, notification to the Institution, and, in serious cases, notification to authorities.

5. User Content, Activities, and Feedback

  • Users may contribute photos, videos, documents, comments, activity responses, voice recordings, and other educational content (“User Content”).
  • User Content may be visible according to permissions assigned by the Institution and may constitute Education Records under FERPA.
  • Users retain ownership of their User Content. CollegeOne is granted a limited license to use, store, display, modify, distribute, and create derivatives of User Content to provide and improve the Platform.
  • Feedback may be used by CollegeOne without compensation.
  • Activities or educational content without personal data (“Student Data Free Output”) are automatically licensed under Creative Commons Attribution 4.0, unless sharing is deactivated by school staff.
  • License termination occurs when content or accounts are deleted, except for content previously shared or retained for legal compliance.
  • Users guarantee they have the rights to submit content and do not infringe third-party rights.

6. Profile Pictures and Personal Content

  1. By uploading a profile picture, the User (or the Institution on behalf of minors) grants permission for CollegeOne to use the picture within the Platform.
  2. Profile pictures must not contain sensitive information or identifiable information of third parties without consent.
  3. For minor students, profile pictures must be authorized by the Institution or parents/guardians.
  4. CollegeOne may use profile pictures only to display user identity within the Platform and not for external commercial purposes.
  5. Profile pictures may be visible to other Users according to Institution-assigned permissions.

7. Warranty Disclaimer and Limitation of Liability

Disclaimer of Warranties:

  • The Platform is provided “as is” and “as available”.
  • CollegeOne does not guarantee that the Platform will meet expectations, be uninterrupted, error-free, secure, or virus-free.
  • Any material downloaded or obtained through the Platform is at the User’s own risk.

Limitation of Liability:

  • CollegeOne and its affiliates shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages.
  • Maximum aggregate liability is limited to the greater of $100 or fees actually paid by the User in the 12 months preceding the claim.
  • Certain jurisdictions do not allow these limitations; in such cases, liability will be limited to the maximum extent permitted by law.

8. Privacy

  • Use of the Platform is governed by CollegeOne’s Privacy Policy, complying with FERPA and applicable data protection laws.

9. Termination

  • CollegeOne may suspend or terminate accounts for violations of these Terms, the AUP, or institutional policies.

10. Governing Law, Jurisdiction, and Venue

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to any conflict of law principles.

Any dispute, claim, or controversy arising out of or in connection with these Terms or the use of the Platform, including its interpretation, breach, enforcement, or termination, shall be subject to the exclusive jurisdiction of the courts located in Aguadilla, Puerto Rico. By using the Platform, you expressly consent to the personal jurisdiction and venue of such courts and waive any objections thereto, including claims of inconvenient forum.
